Corporate - Taxes on corporate income

Pursuant to the Tax Code, resident entities are subject to a corporate income tax, called the 'profit tax', on their aggregate annual income earned worldwide. Non-resident legal entities carrying out business activities through a permanent establishment (PE) in Kyrgyzstan are subject to profit tax on the income attributed to the activities of that PE.

Profit tax is calculated at a rate of 10% of aggregate annual income less allowed deductions.

Gold industry profit tax

The profit tax rate for taxpayers extracting and selling gold ore, gold concentrate, gold alloy, and refined gold is set at 0%.

Additionally, there is a tax ('income tax') specifically for taxpayers extracting and selling gold ore, gold concentrate, gold alloy, and refined gold.

Income tax is calculated at a varying rate of 1% to 20% for gold alloy and refined gold and 8% to 27% for gold ore and gold concentrate till 2023 (from 2023 the rate will vary from 11% to 30% for gold ore and gold concentrate) (depending on the world price of a troy ounce of gold) of revenues from selling gold alloy and refined gold or of the value of gold in the gold-bearing ore and gold concentrate calculated on the basis of world prices.

E-commerce tax

Entities involved in the following can be subject to e-commerce tax: 

  • Provision of services in electronic form based on the use of a domain name or IP-address registered in Kyrgyzstan. Please note that this activity leads to creation of a PE in Kyrgyzstan.
  • Activities of the seller and/or operator of a trading platform in accordance with the legislation of Kyrgyzstan on electronic commerce.

E-commerce tax should be paid instead of the following taxes:

  • Profit tax.
  • VAT on taxable supplies.
  • Sales tax.

The tax base for e-commerce tax is: 

  • Revenue from the provision of services in an electronic form.
  • Revenue from the sale of goods.

The rate for e-commerce tax is 2%.

The tax period for e-commerce tax is a quarter.

Local income taxes

There are no provincial or local income taxes in Kyrgyzstan.
